Service Agreement

  1. Definitions.
    This site is the interactive service operated by the World Union of Jesuit Alumni/ae, consisting of information services and content provided by the World Union of Jesuit Alumni/ae. "Subscriber" means each person who establishes or accesses this site for access to and use of its contents.
  2. General.
    1. This agreement, which incorporates by reference other provisions applicable to use of this site. By using this site (other than to read this agreement for the first time), the subscriber agrees to comply with all of the terms and conditions hereof. The subscriber is responsible for all use of the subscriber's account (under any screen name or password) and for ensuring that all use of the subscriber's account complies fully with the provisions of this agreement. The subscriber shall be responsible for protecting the confidentiality of the subscriber's password(s), if any.
    2. The World Union of Jesuit Alumni/ae shall have the right at any time to change or discontinue any aspect or feature of this site, including, but not limited to, content and equipment needed for access or use.
  3. Changed Terms.
    The World Union of Jesuit Alumni/ae shall have the right at any time to change or modify the terms and conditions applicable to the subscriber's use of this site, or any part thereof, or to impose new conditions. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, notifying it on the home page or by any other means by which the subscriber obtains notice thereof. Any use of this site by the subscriber after such notice shall be deemed to constitute acceptance by the subscriber of such changes, modifications or additions.
  4. Equipment.
    The subscriber shall be responsible for obtaining and maintaining all computer hardware and other equipment needed for access to and use of this site and all charges related thereto.
  5. Subscriber Conduct.
    1. The subscriber shall use this site for lawful purposes only. The subscriber shall not post or transmit through this site any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law, or which, without the World Union of Jesuit Alumni/ae's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a subscriber that in the World Union of Jesuit Alumni/ae's discretion restricts or inhibits any other subscriber from using or enjoying this site will not be permitted.
    2. This site contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound. The entire contents of this site are copyrighted as a collective work under the Italian copyright laws. The World Union of Jesuit Alumni/ae owns a copyright in the selection, co-ordination, arrangement and enhancement of such content, as well as in the content original to it. When a copyright signs appears on this site which refers to others than the World Union of Jesuit Alumni/ae, the World Union of Jesuit Alumni/ae had the mere permission from the owner of the copyright to publish the contents on the site but, by no means, has any other right besides that. Please refer to the owner of those rights for any type of permission. The subscriber may download copyrighted material for the subscriber's personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of the World Union of Jesuit Alumni/ae or other copyright owners. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The subscriber acknowledges that it does not acquire any ownership rights by downloading copyrighted material.
    3. The subscriber shall not upload, post or otherwise make available on this site any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with the subscriber. The subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of this site, the subscriber automatically grants, or warrants that the owner of such material has expressly granted the World Union of Jesuit Alumni/ae the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) world-wide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. The subscriber also permits any other subscriber to access, view, store or reproduce the material for that subscriber's use.
    4. The foregoing provisions of section 5 are for the benefit of the World Union of Jesuit Alumni/ae, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.
  6. Disclaimer of Warranty; Limitation of Liability.
    1. The subscriber expressly agrees that use of this site is at subscriber's sole risk. Neither the World Union of Jesuit Alumni/ae, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that this site will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of this site, or as to the accuracy, reliability or content of any information, service, or merchandise provided through this site.
    2. This site is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.
    3. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. The subscriber specifically acknowledges that the World Union of Jesuit Alumni/ae is not liable for the defamatory, offensive or illegal conduct of other subscribers or third-parties and that the risk of injury from the foregoing rests entirely with subscriber.
    4. In no event will the World Union of Jesuit Alumni/ae, or any person or entity involved in creating, producing or distributing this site or its software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use this site. The subscriber hereby acknowledges that the provisions of this section shall apply to all content on this site.
    5. In addition to the terms set forth above neither, the World Union of Jesuit Alumni/ae, nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within this site, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Prior to the execution of a trade, subscribers are advised to consult to verify pricing or other information. The World Union of Jesuit Alumni/ae, its affiliates, information providers or content partners shall have no liability for decisions based on the information provided. Neither, the World Union of Jesuit Alumni/ae, nor its affiliates, information providers or content partners warrant or guarantee the timeliness, sequence, accuracy or completeness of this information. Additionally, there are no warranties as to the results obtained from the use of the information.
  7. Monitoring.
    The World Union of Jesuit Alumni/ae shall have the right, but not the obligation, to monitor the content of this site, to determine compliance with this agreement and any operating rules established by the World Union of Jesuit Alumni/ae and to satisfy any law, regulation or authorised government request. The World Union of Jesuit Alumni/ae shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on this site. Without limiting the foregoing, the World Union of Jesuit Alumni/ae shall have the right to remove any material that the World Union of Jesuit Alumni/ae, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.
  8. Indemnification.
    The subscriber agrees to defend, indemnify and hold harmless the World Union of Jesuit Alumni/ae, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of this site by the subscriber or the subscriber's account.
  9. Termination.
    Either the World Union of Jesuit Alumni/ae or the subscriber may terminate this agreement at any time. Without limiting the foregoing, the World Union of Jesuit Alumni/ae shall have the right to immediately terminate the subscriber's account in the event of any conduct by the subscriber which the World Union of Jesuit Alumni/ae, in its sole discretion, considers to be unacceptable, or in the event of any breach by the subscriber of this agreement. The provisions of sections 5(B), 5(C), 5(D), 6, 8, 10 and this section 9 shall survive termination of this agreement.
  10. Trademarks.
    All rights reserved. All trademarks appearing on this site are the property of their respective owners.
  11. Third Party Content.
    1. In many instances, the content available through this site represents the opinions and judgements of the respective information provider, the subscriber, or other user not under contract with the World Union of Jesuit Alumni/ae. The World Union of Jesuit Alumni/ae neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on this site by anyone other than authorised the World Union of Jesuit Alumni/ae employee spokespersons while acting in their official capacities. Under no circumstances will the World Union of Jesuit Alumni/ae be liable for any loss or damage caused by a subscriber's reliance on information obtained through this site. It is the responsibility of the subscriber to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through this site.
    2. This site contains links to other Internet sites. These links are not endorsements of any product or service in such sites, and no information in such site has been endorsed or approved by the World Union of Jesuit Alumni/ae.
  12. Miscellaneous.
    This agreement and any operating rules for this site established by the World Union of Jesuit Alumni/ae constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This agreement shall be construed in accordance with the laws of the Italian country, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.



World Union of Jesuit Alumni’s mailing list:
Service Agreement

  1. Nature of the List
    The World Union of Jesuit Alumni’s mailing list exist for the only purpose of keeping the Jesuit Alumni and friends informed of all the news coming for the Union itself. No other type of message will ever be sent to this mailing list.
  2. Identity Disclosure
    1. No message to the World Union of Jesuit Alumni’s mailing list will ever come from others than the World Union webmaster, who is the responsible for its correct management. The World Union agrees not to operate with forged source or "From:" identification and will never use a third party's e-mail address (domain name) without permission and keeping safe.
    2. It may temporary use an autoresponder as a reply-to address but it must also make sure they use an e-mail address capable of accepting replies at the time of mailing.
    3. In addition, the World Union agrees not to send more direct e-mails than it can handle in a reasonable period.
  3. Selling or Sharing of the List
    As a consequence of points 2 and 3, the World Union of Jesuit Alumni’s mailing list will never be sold, rent, traded or distributed (as a whole or in part( to thirds parts outside the World Union itself
  4. E-mail Address Procurement
    1. The World Union agrees that all email addresses shall be collected solely from publicly accessible sources, to include Sent Email Messages, Opt-In Requests, Subscriptions, Newsgroups, Focused Search Engine Extraction, List Servers, New User Chat Rooms, Forums, Web Malls and various other Public Web Sites.
    2. Data collection using automated or other equipment is subject to the provisions or the local data protection law.
    3. Individual privacy rights will be respected at all times.
  5. Content of Messages
    1. The World Union shall not knowingly send to the mailing list direct e-mail which content is deceptive or misleading, or misrepresenting. It will always send messages which inform or promote services which are of interest to the target of this mailing list. The World Union shall not knowingly send direct e-mail which, in their opinion, may tend to violate any local, state or federal laws. Further, it will not knowingly provide service for the purpose of distributing of racial, political, or personal attacks of any type. Any material such as "chain letters", "pyramid schemes", and/or "Ponzi plans" that violate state or federal law shall not be distributed to the list. Transmission of any material protected by state or federal laws, such as patents and copyrights, are also prohibited.
    2. We will not be liable for any and all misuse of Internet Software and/or Internet Accounts, under any circumstances. We will not be liable for any and all damages, liabilities, losses, costs and expenses, including legal fees, which result from misuse of Internet Software and/or Internet Accounts.
  6. Disclaimer of Warranty
    1. The recipient of the World Union of Jesuit Alumni’s mailing list messages expressly agrees that reading of the messages is at recipient's sole risk. Neither the World Union of Jesuit Alumni/ae, its affiliates nor any of their respective employees, agents, third party content providers or licensors make any warranty as to the results that may be obtained from use of these messages, or as to the accuracy, reliability or content of any information, service, or merchandise provided through these.
    2. This disclaimer of warranty applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

  7. Subject Field
    All mailings by members must include a valid and not misleading headline in the subject heading of any mailings.
  8. Contact Details Inclusion
    All messages to the World Union of Jesuit Alumni’s mailing list must add the full name, address and telephone number of the sender within the message. It must adopted this format for their mailings:

    Further transmissions to you by the sender may be stopped at no cost to you by forwarding this e-mail to remove@jesuitalumni.org.

  9. Removal Requests
    All messages to the World Union of Jesuit Alumni’s mailing list must add a simple statement which should be prominently displayed at the beginning of every direct e-mail message and will take the form of the following:

    This message came to you being your email address included in the World Union of Jesuit Alumni’s mailing list.
    Please see http://www.jesuitalumni.org/discgb.htm for further information and removal instructions.

  10. Promptness of Removal
    The World Union webmaster must process removal requests before any further send of message to the mailing list.
  11. Email Harrassment
    Electronic email harrassment is expressly prohibited. The World Union will take every precaution against terrorist actions from individuals and groups who may be opposed to it. If the World Union becomes the target of an attack, retaliation shall be by legal remedy only.
  12. SMTP Servers
    The World Union agrees to use a valid SMTP (mail) server and have received express permission from its ultimate domain. Under no circumstances shall it use a SMTP server without express permission from it ultimate domain and without following the rules laid down by such SMTP servers. The Service Provider must send the transmissions to the list.
  13. Coexistence with ISPs
    Because the nature of the Internet is based on cooperation between unaffiliated network providers, the World Union intend to cooperate with other Internet Service Providers so as not to become a nuisance, or place any unnecessary burden on any other ISP in the course of its conducting its action. This may require scheduling mailing at a time and volume agreeable to the parties involved, or in some cases, requiring that entire domains be filtered or removed from mailing lists entirely. If this is an area which requires attention, please contact us.

    The World Union reserves the right to modify these terms and conditions at any time, without prior notification.
